    You have the right to move out and adhere to the divorce decree by expecting him to refinance and then you sign a quick claim. That is what the decree calls for. Because you decided to switch things up and not move does not change the letter of the law. Because you are now resentful does not mean the divorce actions are different. You said your 17 year old is seeing all this….did you not know that when you decided to divorce then stay there so you both could make a further mess of things?

    Chrome is right. You’ve got a problem on your hands. He didn’t refinance the house because his payment would no doubt be higher. That’s what happened to me but a higher house payment was worth it. The whole girlfriend in the other room is messed up. You do have some say in this but I’d see a lawyer anyway.

    It’s been 4 years since the divorce and you don’t expect him to have a girlfriend? And you have been living expense free in the house and you want to cause trouble? What a piece of work. File a contempt of court motion for the lack of refinancing and move on already.
