    Sounds fair enough. You get half ownership, you get half responsibility. You shouldn’t expect you will just get half ownership if you are unwilling to take any risk or responsibility.

    otherwise he is wholly responsible for the payments, while sharing 50% of the equity -

    It depends on the state. I’m not sure how it is in Pennsylvania, but in NC, since you are married, the house is marital property and you own half of it whether you are on the deed or not. Even if you aren’t on the deed, when it comes to refinancing, you would have to sign the deed of trust anyway. Sounds to me like everything is on the up and up, especially since you have advice from his attorney. Go ahead and sign the mortgage, you probably have to anyway. If you still feel iffy about it, there’s nothing stopping you from contacting your own attorney.

    legally it makes no difference. by marriage you have rights to half the house and you are responsible for half the debt if you were to divorce. unless you’ve signed a prenup its 50/50 all the way.

    If you want to be entitled to the asset, you have to be responsible for the debt that goes with it.

    I don’t understand what being sued has to do with anything. If the home is in his name only and he is sued, he can lose the home. If the home is in both names, you can BOTH be sued and lose the home. You would appear to be better off leaving this asset wholly in his name if you think he’s going to get sued. (I’ve never in my life heard of a woman wanting to held responsible for a property just in case her husband gets sued. This is wierd.)

    Admit it. Your real reason for getting your name on the deed isn’t in case he gets sued, it’s for when you sue him for divorce.

    If you don’t want anything to do with the mortgage, then you shouldn’t be on it. You want to be on it “for him in case he gets sued”, which makes you liable as well, but then you don’t want to be on it because you don’t want your name on the refi. You can’t have it both ways…either you’re in 100% or not. You sound selfish.

    He’s a wise man. I put her on the deed. Now I owe the money, and since the divorce, she owns half the house without the debt.

    PA is a Commonwealth and you are entitled to half of the house whether you are on the deed or not.

    This is in”deed” an American women. You want the house but not the obligation.

    It’s not about being sued as if you are sued the house is safely in his name now.
